Learned counsels for the respective parties submit that the

issue involved herein is no more res integra and stands resolved

by a Division Bench judgment of this Court dated 06.08.2013

delivered in the case of State of Rajasthan & Ors. Vs. Dr.

Ashok Singhvi: D.B. Special Appeal (Writ) No.232/2013 and

various other pronouncements of this Court.

In view thereof, this writ petition is allowed. The respondents

are directed to consider candidature of the petitioner for

promotion in the next DPC or by conducting review DPC within a

period of three months from the date of communication of this

order.
