For Petitioner(s) : Mr. Sandeep Singh Tanwar for Mr. R.B. Sharma Ganthola For Respondent(s) :

HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL

Judgment / Order

02/05/2024

This writ petition has been filed assailing the judgment dated

20.02.2018 passed by the Information Commissioner whereby,

the appeal preferred by the petitioner/applicant under the Right to

Information Act, 2005 has been dismissed.

Assailing the order, only contention advanced by the learned

counsel for the petitioner is that although, the information sought

by him was supplied with delay, the Information Commissioner

erred in not awarding him penalty of ₹25,000/-. He, therefore,

prays that the judgment dated 20.02.2018 be quashed and set

aside and the respondents may be directed to pay him the penalty

of ₹25,000/-.

Head. Considered.

[2024:RJ-JP:20730] (2 of 2) [CW-14950/2019]

The appeal preferred by the petitioner was dismissed by the

Information Commissioner on the premise that the requisite

information was already supplied to him. So far as the imposition

of penalty is concerned, learned counsel for the petitioner fairly

submits that it is discretionary jurisdiction of the Information

Commissioner.

In view thereof, this Court finds no reason under its writ

jurisdiction to interfere with the discretionary order passed by the

Information Commissioner.

Resultantly, this civil writ petition is dismissed being devoid

of merit. Pending application(s), if any, also stands disposed of.
