1. After arguing some time, Mr. Rathore learned counsel for the

petitioner submits that the petitioner would be satisfied if a

direction is issued to the competent authority of respondents to

consider and decide petitioner's representation in the light of

judgment dated 15.09.2016 rendered in the case of Surendra

[2024:RJ-JD:8105] (2 of 2) [CW-5325/2017]

Singh vs State of Rajasthan and another in S.B. Civil Writ

Petition No.7638/2008.

2. In view of the aforesaid, the present writ petition is disposed

of with a direction to the petitioner to file a representation, along

with a photo-stat copy of the judgment in the case of Surendra

Singh (supra) and the order instant, within a period of four weeks.

3. In case, a representation is so addressed within the aforesaid

period, the competent authority shall consider and decide the

same in accordance with law, preferably within a period of eight

weeks from the date of receipt of the representation.

4. It is made clear that aforesaid direction to decide the

representation has been issued only with a view to ensure

expeditious redressal of petitioner's grievance. The same may not

be construed to be an order to decide the representation in a

particular manner.
