The present revision petition has been filed by the petitioner

against the order dated 25.08.2023 passed by the learned Special

Judge, SC/ST Act Cases, Rajsamand in Criminal Appeal

No.32/2023 whereby the appellate court has partly allowed the

appeal of the petitioner and modified the judgment and sentence

dated 13.03.2019 passed by the Learned Judicial Magistrate,

Kumbhalgarh in Regular Case No.227/2017 whereby learned

Magistrate has convicted and sentenced the petitioner for offence

under Section 420 IPC, two years' S.I. and imposed a fine of

Rs.5,000/- in default of payment of fine further to undergo one

month S.I.

Counsel for the petitioner submits that the appellate court

has given the benefit of probation to the petitioner under Section

4 of Probation of Offenders Act and ordered the petitioner to

submit a bail bond Rs.10,000/- before the trial Court to maintain

peace and good behaviour for a period of one year and also

imposed a penalty of Rs.2,000/- as prosecution expenses. The

appellate court has granted one month time to the petitioner to

submit the bail bond as well as to deposit the prosecution

expenses. But the the petitioner could not submit the bail bond of

Rs.10,000/- as well as prosecution expenses. In these

circumstances, it is prayed that some more time may be granted

to the petitioner to submit the bail bond as well as prosecution

expenses.

Learned Public Prosecutor has opposed the prayer made by

learned counsel for the petitioner.

I have heard and considered the arguments advanced before

me and perused the material available on record.

In view of the aforesaid circumstances, the petitioner is

granted fifteen days' time to submit the bail bond as well as

prosecution expenses and comply with the order dated

25.08.2023 passed by learned Special Judge, SC/ST Act Cases,

Rajsamand.

The revision petition is decided. Stay petition also stands

decided.
