This writ petition, which has been filed assailing the

decision taken by the respondent No.3 in its meeting

dated 20.10.2011 qua the petitioner, is being disposed of

in following terms as agreed and requested by the learned

counsels for the respective parties:-

1. The decision of the respondent No.3 taken qua the petitioner in its meeting dated 20.10.2011 is quashed and set aside.

2. However, the respondent No.3 is at liberty to proceed against the petitioner afresh after following the principles of natural justice.

3. The exercise shall be completed within a period of six months from the date of communication of this order. The amount of the petitioner-firm withheld by the respondent No.3 shall remain subject to decision afresh, if any, and if the exercise is not completed within a period of six months, it shall be released in favour of the petitioner.
