HON'BLE MR. JUSTICE SAMEER JAIN Order

1. The present petition is filed with the following prayers:-

"(a) This reply to the writ petition may kindly be taken on record and the writ petition filed by the petitioners may kindly be dismissed with cost.

(b) Any order or direction in the interest of justice and in the favour of the answering respondents may kindly be passed, which this Hon'ble Court may be deem fit and proper under the facts and circumstances of the case."

2. Learned counsel for the petitioner has submitted that

petitions of an akin and indistinguishable nature, have already

been allowed and/or adjudicated in favour of the petitioner, vide

[2024:RJ-JP:17430] (2 of 2) [CW-3750/2019]

order dated 20.07.2018 in S.B. CWP No. 8135/2017 titled as

Dr. Manish Kumar Sharma vs. State of Raj., which was further

upheld by Division Bench of this Court in DBSAW No.

1551/2019 titled as Dr. Santosh Kumar Nagar vs. State of

Raj. & Ors. and subsequently, by the Hon'ble Apex Court as well.

3. Learned counsel for the respondents has not refuted the said

contentions and accepting the same, it was further submitted that

in the light of the said judgments and considering the principles of

judicial discipline, the same relief be granted in terms of judgment

of Dr. Manish Kumar Sharma (Supra).

4. Considering the arguments advanced by learned counsel for

both the sides, the present petition is allowed in terms of the

dictum of this Court as enunciated in Dr. Manish Kumar Sharma

(Supra), which has attained finality as on date. The same relief

be granted in favour of the petitioner.

5. Accordingly, the present petition is allowed. Pending

applications, if any, stand disposed of.
