1. An application under Order XXIII Rule 3 r.w. Section 151 of

the Code of Civil Procedure has been preferred jointly on behalf of

the appellants and the respondents with a submission that an

amicable settlement has been arrived into between the parties on

the terms as narrated in the said application.

2. On the said application being filed, this Court, vide order

dated 12.09.2023, directed all the parties to appear before the

Deputy Registrar (Judicial) of this Court who, was further directed

to verify the contents of the application as well as the parties. In

pursuance to the order dated 12.09.2023, the Deputy Registrar

(Judicial) proceeded on to verify the parties who had been

identified by their respective counsels. He further verified that the

parties had been read over and explained the contents of the

compromise which have been accepted by them to be true and

correct.

4. In view of submissions made in the application and the terms

of settlement as arrived into between the parties, the impugned

judgment and decree is set aside and the present appeal is

disposed of in terms of the settlement as reproduced above.

6. All the pending applications, if any, also stands disposed of.
