Heard learned counsel for the petitioner.
Learned counsel for the petitioner submits that for no fault of
the petitioner, he has been put under suspension vide order dated
13.02.2023. He further submits that after issuance of the
suspension order, neither any departmental inquiry has been
initiated nor any criminal proceedings have been initiated against
the petitioner. He submits that in the present case, continuance of
the suspension of the petitioner is in violation of the judgment of
the Hon'ble Supreme Court rendered in the case of Ajay Kumar
Choudhary V/s Union of India & Ors. reported in (2015) 7
SCC 291.

The matter requires consideration.
Issue notice. Issue notice of stay application also, returnable
within a period of four weeks.
In the meanwhile and till further orders, effect and operation
of the suspension order dated 13.02.2023 (Annex.5) and relieving
order dated 14.03.2023 (Annex.6) shall remain stayed.
