The writ petition filed by the appellant has been dismissed by

the learned Single Judge, though for non prosecution, but taking

into consideration the fact that the controversy raised by the

appellant in the writ petition is squarely covered by Division Bench

[2023/RJJD/016959] (2 of 2) [SAW-335/2022]

judgment dated 13.08.2019 rendered in the case of State of

Rajasthan & Ors. vs. Satya Dev Bhaggur (D.B. Special Appeal

No.837/2019).

Learned counsel for the appellant has placed on record the

copy of the order passed by Hon'ble the Supreme Court dated

17.02.2022 passed in Civil Appeal No.1422/2022, whereby the

Hon'ble Supreme Court has affirmed the decision dated

13.08.2019 passed in State of Rajasthan & Ors. vs. Satya Dev

Bhaggur.

In view of the above facts and circumstances of the case, we

do not find any merit in this appeal and the same is hereby

dismissed.
