I.A. No. 02/2023:

1. For the reasons stated, the application seeking early listing

of the matter is allowed.

2. The matter is taken up for consideration today itself.

S.B. Civil Writ Petition No. 850/2019:

1. Mr. Choudhary, learned counsel for the petitioner submits

that the controversy involved in the present writ petition is

covered by the judgment dated 08.10.2015 passed by the co-

ordinate Bench of this Court in the case of Durga Ram Jat vs.

[2023/RJJD/016738] (2 of 2) [CW-850/2019]

State of Rajasthan & Ors (S.B. Civil Writ Petition No.

9695/2014).

2. Mr. Sarwan Kumar, learned counsel for the respondents is

not in a position to dispute the aforesaid position of facts and law.

3. In the case of Durga Ram Jat (supra), this Court has held

thus:

"In view of above discussions, the writ petitions filed by the petitioners are allowed. The respondents are directed to grant all the benefits including benefit of Pension Rules, 1996 and ACP with all consequential benefits to the petitioners as indicated in the order passed by the Division Bench and order dated 24.02.2005 (Annex-6).

The exercise may be completed by the respondents within a period of three months from the date a certified copy of this order is placed before the respondents.

No order as to costs"

4. Following the judgment aforesaid, and Division Bench

judgment dated 24.02.2005 in D.B. Civil Special Appeal No.

684/2004, the present writ petition is allowed.

5. The Respondents are directed to grant all consequential

benefits including the benefit of Pension Rules, 1996, ACP and

seniority to the petitioner within a period of eight weeks from

today.

6. Stay application also stands disposed of.
