HON'BLE MR. JUSTICE FARJAND ALI Order
10/05/2023
1. The petitioner happens to be the father of the victim and
complainant of the case, in which, after a full fledged trial and a
thread bare discussion of the evidence brought on record, the
learned trial Court acquitted the accused respondent by giving him
benefit of doubt.
2. A cursory look over the statement of the witnesses
persuaded this Court to interfere in this matter. There appears
reasonable and valid grounds to allow the petitioner to prefer an
appeal against the judgment of acquittal.
3. Accordingly, the instant application seeking leave to appeal is
allowed. The memo of leave to appeal application shall be treated
and registered as an appeal.
4. Office to proceed.
