HON'BLE MR. JUSTICE VINIT KUMAR MATHUR Order
05/05/2023 Learned counsel for the petitioner submits that the controversy involved in the present case is covered by a Division Bench judgment rendered in D.B. Special Appeal Writ No.662/2022 (Jahangir Ali Khan Vs. State of Rajasthan & Anr.) decided on 25.05.2022.
Learned counsel for the respondents is not in a position to refute the submissions made by the learned counsel for the petitioner.
The writ petition is, therefore, disposed of in light of the judgment rendered by the Division Bench of this Court in the case of Jahangir Ali Khan (supra).
Resultantly, the suspension order dated 31.03.2023 is quashed and set aside and the respondents will be free to take appropriate action afresh against the petitioner in accordance with the Rules.
