Heard learned counsel for the petitioner.

Learned counsel for the petitioner submits that the petitioner

is due to superannuate from the services on 31/12/2024. He

submits that less than two years are remaining for the petitioner

to superannuate. He submits that the petitioner is being

transferred from Barmer to Ajmer and the said transfer is contrary

to the judgment of this Court rendered in the case of Dr. Pushpa

Mehta v. Rajasthan Civil Services Appellate Tribunal, Jodhpur &

Anr. (D.B. Special Appeal Writ No.11538/1999, decided on

(2 of 2) [CW-1755/2023]

16.12.1999. He further submits that the petitioner has not been

relieved so far.

Matter requires consideration.

Issue notice. Issue notice of stay application also, returnable

in four weeks.

In the meanwhile and until further orders, the impugned

transfer order dated 15/01/2023 qua the petitioner shall remain

stayed, if the petitioner has yet not been relieved in pursuance of

the transfer order dated 15/01/2023.
