The matter comes up for consideration of application (1/23)

filed on behalf of the petitioner seeking early listing of the writ

petition.

The next date fixed by the Registry in the matter is

24.4.2023.

Learned counsel for the petitioner has submitted that by 31 st

March, 2023, the respondents would pass the assessment order

(2 of 2) [CW-2207/2023]

pursuant to the notice under Section 148 of the Income Tax Act,

therefore, the matter may be heard today itself.

Having gone through the material available on record, we are

of the view that the matter cannot be heard today itself.

However, we make it clear that in case the final assessment

order is passed by the Assessing Authority, the same shall be

subject to the final outcome of this writ petition.

List the matter on 24.4.2023, the date already fixed by the

Registry.

The above-referred application seeking early listing the writ

petition is disposed of.
