20/01/2023 Counsel for petitioner states that petitioner was suspended

vide order dated 14.10.2020 and thereafter, neither any charge-

sheet has been issued nor any departmental inquiry is pending

against the petitioner. The authority declined to revoke the

suspension without any just cause and without adverting to the

Judgment of Hon'ble the Supreme Court in case of Ajay Kumar

Choudhary Vs. Union of India [(2015) 7 SCC 291].

Heard.

Issue notice.

In the meanwhile, suspension order of petitioner dated

14.10.2020 (Ann.1) and order dated 10.05.2022 (Ann.12) shall

remain stayed.
