In view of the judgments cited before this Court by the

learned counsels for the respective parties in the cases of Bani

Singh & Ors. versus State of U.P.: (1996) 4 Supreme Court

Cases 720, Mohd. Sukur Ali versus State of Assam: (2011)

4 Supreme Court Cases 729 & judgment dated 05.07.1988

passed by a Coordinate Bench of this Court in SB Cr. Misc.

Petition No.83/1988: Chhaja versus State of Rajasthan, this

Court deems it just and proper to issue notice to the accused-

appellant before deciding the appeal on its merit after hearing the

learned Amicus Curiae.

In view thereof, issue notice to the accused-appellant. Rule is

made returnable by three weeks.

The Superintendent of Police, Dausa is directed to ensure

service of notice upon the accused-appellant.
