HON'BLE MR. JUSTICE SUDESH BANSAL Order 03/02/2023
1. Reply to the writ petition has been filed.
2. Learned counsel for respondents states that Rule 412 of the Rajasthan Land Revenue (Land Records) Rules 1957 (hereinafter referred as "the Rules of 1957") does not apply to the present case and has placed reliance upon the judgment passed in case of Gopalram Vs. The State of Rajasthan, [2020 2 RLW 958 (Raj.)].
3. Per contra, counsel for petitioners, on the strength of judgment delivered in Rajpal Singh Vs. State of Rajasthan, [2021 2 RLW 1071 (Raj.)], states that in view of the Rule 9 (ii) of the Rules of 1957 the impugned transfer order stands illegal.
4. Matter requires consideration.
5. Pleadings are complete, list the matter on 27.2.2023 for final arguments.
6. In the meanwhile, the transfer order dated 14.1.2023 qua petitioner shall remain stayed and petitioner shall be allowed to continue to work at Patwar Mandal, Sirsi, Jaipur where he was working prior to issuance of transfer order.
