----Petitioner Versus Smt. Hasiran Bano W/o Ahmad Noor Ansari

----Respondent

For Petitioner(s) : Mr. A.R. Meena For Respondent(s) : Mr. Kuldeep Aswal Mr. Sandeep Sharma

HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL

Order

03/02/2023

Since, these writ petitions share common facts and questions

of law, they have been heard together.

Prayer in the writ petitions is to quash and set aside the

order dated 15.12.2014 passed by the Additional District Collector,

Bundi whereby, the appeals preferred by the respondent No.1

against the grant of Patta by the respondents No.2 & 3, Nagar

Palika Nainwa, District Bundi in favour of the petitioners, have

been allowed.

Learned counsel for the petitioners submits that the

Additional District Collector, Bundi did not have jurisdiction to

entertain the appeals preferred by the respondent No.1 against

(2 of 2) [CW-12338/2020]

the allotment of the subject plot in their favour by the Nagar

Palika Nainwa, District Bundi which could lay before the Director,

Local Bodies only. He, therefore, prays that the writ petition be

allowed and the order dated 15.12.2014 be quashed and set

aside.

After making submission for some time, learned counsels for

the respondents pray for an adjournment.

In view thereof, learned counsel for the petitioners prays for

an interim order.

List these matters after four weeks as prayed by learned

counsels for the respondents.

However, to balance equities, this Court deems it just and

proper to stay the operation and effect of the judgment dated

15.12.2014 passed by the Additional District Collector, Bundi

which, on the face of it, appears prima facie to be without

jurisdiction, till the next date.
