The petitioner-appellant was inflicted with the punishment of
reduction of his 15% pension after holding a due enquiry. There is
no dispute that the petitioner-appellant had participated in the
disciplinary enquiry and after the enquiry report was submitted, a
show cause notice was given, whereupon the order of punishment
was passed.
The submission of learned counsel for the petitioner-
appellant is that Rule 7 of the Pension Rules, 1996 contemplates
of a notice regarding proposed punishment and that the
petitioner-appellant was not served with any such notice.
We have considered the above Rule 7 and we do not per se
find that it contemplates of giving any show cause notice
regarding the proposed punishment.
Learned counsel for the petitioner-appellant prays for and is
allowed two weeks time to further study the matter and to place

the relevant rule instead of relying upon the judgments of the
learned Single Judge in this regard.
List after two weeks.
