HON'BLE MR. JUSTICE ARUN BHANSALI HON'BLE MR. JUSTICE RAJENDRA PRAKASH SONI
Order
27/04/2023
1. During the course of submissions, learned counsel for the
petitioner relied on judgment in Om Prakash @ Omi vs. The State
of Rajasthan & Ors. : D.B. Habeas Corpus Petition No.217/2022
decided on 01.12.2022 at Jaipur Bench regarding interpretation of
provisions of Section 9 of the Rajasthan Prevention of Anti Social
Activities Act, 2006.
2. Learned Additional Advocate General attempted to rely on
the compliance based on document contained in the official
record, however, the same apparently has not been placed on
record of this case.
3. On 18.04.2023 also, it was noticed that the relevant material
on the part of respondents was not on record of the case and on a
prayer being made, one opportunity was granted and it was
observed that if the needful was not done/entire material was not
(2 of 2) [HC-3/2023]
placed on record before the next date, no further opportunity shall
be granted.
4. However, for a fair disposal of the present petition, we feel
that the document sought to be relied on by the State is relevant,
and therefore, one last opportunity is granted for placing the said
document/any other document on record.
5. List the petition on 01.05.2023.
