The applications seeking early listing of the matter has been

rendered infructuous by the efflux of time.

Dismissed accordingly.

The matter is taken up for consideration today itself.

S.B. Civil Writ Petition No. 9093/2020:-

1. Mr. Dinesh Bishnoi, learned counsel for the petitioner, at the

outset, submits that the issue involved in the present writ petition

is squarely covered by the judgment of this Court dated

11.08.2014 rendered in the case of Arun Choudhary & Ors. Vs.

[2023/RJJD/009725] (2 of 2) [CW-9093/2020]

State of Rajasthan & Ors. : S.B. Civil Writ Petition No.

5255/2013, decided on 11.08.2014 at Jaipur Bench.

2. He further submitted that following the judgment in the case

of Arun Choudhary (supra), various writ petitions have been

allowed.

3. Mr. Choudhary is not in a position to controvert the above

submission.

4. In view of the above fact situation, the writ petition filed by

the petitioner is allowed. The respondents are directed to

reimburse the amount of salary (excluding the training expenses)

that was recovered from the petitioner, within a period of two

months from today. The respondents shall also pay interest @ 6%

p.a. from the date of recovery till the date of actual payment.

5. The stay application also stands disposed of accordingly.
