For Appellant(s) : Mr. Vikas Jakhar, Advocate

HON'BLE THE ACTING CHIEF JUSTICE MR. MANINDRA MOHAN SHRIVASTAVA HON'BLE MR. JUSTICE VINOD KUMAR BHARWANI

Judgment / Order

27/09/2022

This appeal is directed against order dated 27.06.2022

passed by the learned Single Judge, whereby, writ petition,

challenging the reduction of number of posts originally advertised,

has been dismissed.

Learned counsel for the appellant would submit that though

the respondents-authorities have power to increase or decrease

the number of posts during the process of recruitment, the

(2 of 2) [SAW-1045/2022]

reasons, which have been assigned in various communications, do

not show that there was an imminent need of reducing the posts.

After having gone through the order passed by learned

Single Judge and various communications, we find that the

respondents-authorities, during pendency of the process of

recruitment, decided to reduce the number of posts. As the

increase and decrease has nexus with the financial constraints and

other administrative reasons, in the absence of any right with the

appellant, who is only a candidate in the selection process, the

learned Single Judge has not committed any illegality, warranting

interference in the appeal and the appeal is, therefore, dismissed.
