Appellant-Insurer has preferred this appeal under Section

173 of the Motor Vehicles Act, 1988 (for short, 'Act') to challenge

judgment and award dated 01.06.2011, passed by Motor Accident

Claims Tribunal (First), Jodhpur (for short, 'learned Tribunal').

Learned Tribunal, by the impugned judgment and award, while

adjudicating claim of the claimant-respondent under Section 166

read with Section 140 of the Act, has quantified and awarded

compensation to the tune of Rs.35,000/- under different heads.

During the pendency of the present appeal, the parties have

entered into a Memorandum of Understanding on 19.09.2022,

which is taken on record. As per the said Memorandum of

Understanding, learned counsel appearing on behalf of Insurance

Company seeks permission to withdraw this appeal with liberty to

move an application for recalling of this order in the event of any

appeal or cross-objection is found to have been filed by the

claimant/owner/driver of the vehicle.

In view of the above, the present appeal is disposed of as

withdrawn in light of the Memorandum of Understanding dated

19.09.2022.
