Appellant-plaintiff has preferred the instant second appeal
under Section 100 CPC, assailing the judgment and decree dated
14.02.2017 passed in Civil Regular Appeal No.28/2015 by the
Court of District Judge, Jhunjhunu (Raj.), affirming the judgment
and decree dated 09.09.2015 passed in Civil Suit No.53/2008 by
the Court of Senior Civil Magistrate, Nawalgarh, Dist. Jhunjhunu,
whereby and wherunder plaintiff's suit for permanent injunction
has been dismissed.
Learned counsel for appellant-plaintiff fairly submits that
since he is contesting proceedings under Section 91 of the
Rajasthan Land Revenue Act, 1956, in respect of his possession
over Khasra No.518, Gram Togda Kalan, Tehsil Nawalgarh, Dist.
(2 of 2) [CSA-264/2017]
Jhunjhunu, therefore, he does not want to press the second
appeal.
In view above, the instant second appeal is dismissed as not
press.
All pending application(s), if any, also stand(s) disposed of.
