merits, seeks some time to seek instructions from the appellant to

vacate the suit premises subject to condition that the respondent-

landlord shall not claim the enhanced amount of mesne profit as

ordered by the First Appellate Court in its judgment dated

12.08.2022.

Learned counsel for respondent submits that no cause of

action has been filed.
