HON'BLE THE CHIEF JUSTICE MR. PANKAJ MITHAL HON'BLE MR. JUSTICE SANDEEP MEHTA

Order

18/10/2022

Heard learned counsel for the appellant.

This intra-Court appeal has been preferred against the

judgment and order dated 08.07.2021 passed by the writ Court

dismissing the writ petition filed by the petitioner-appellant.

The petitioner was appointed on daily wages and his services

were dispensed with vide order dated 21.05.2009 on the ground

(2 of 2) [SAW-92/2022]

of absence from duty. The petitioner accepted the said order and

failed to challenge the same for a considerable period of time. It

was only after 11 years that he filed a writ petition challenging the

aforesaid order. The writ petition has been dismissed on the

ground of gross delay and laches. We do not find any error or

illegality in dismissing the writ petition on the above score.

The intra-Court appeal has no merit and is dismissed

accordingly.
