The first appeal has been filed by the appellant-plaintiff

feeling aggrieved by the impugned order whereby and whereunder

his civil suit has been dismissed being barred by principle of

res judicata under Section 11 as also under Order 2 Rule 2 & 3

CPC vide judgment and decree dated 24.11.2015.

Learned counsel for respondent pointed out that the issue

has already been solved at rest in the previous litigation even up

to the Hon'ble Supreme Court.

Having considered the aforesaid facts and circumstances, let

this first appeal be listed for hearing on 12.12.2022 in

'supplementary list'.
