In S.B. Criminal Revision Petition No. 341/2020:
Learned counsel for the petitioner-husband submits that the
maintenance awarded to the respondent No.1-wife to the tune of
Rs.7500/- per month and to the respondent No.2-son to the tune
of Rs.7500/- per month is excessive.
Learned counsel further submits that the petitioner-husband
is a Government Teacher and has a reasonable income.
Learned counsel for the respondents opposes the
submissions.
This Court finds that the petitioner-husband is a government
servant, therefore, the respondents are entitled to get the
maintenance and no cause of interference in the present petition
is made out.
Thus, it is directed that the petitioner-husband shall continue
to pay the monthly maintenance to the respondent No.1-wife and
respondent No.2-son, but arrears, which are about Rs.3,00,000/-,
shall be paid in three equal installments i.e. first installment shall
be paid within a period of four months from today; second
installment shall be paid within a period of eight months from
today and third installment shall be paid within a period of twelve
months from today.
It is needless to say that the monthly maintenance shall be
paid in accordance with the impugned order, the only relief
granted to the extent of arrears, which shall be abided by as
above.
With the aforesaid observations and directions, the present
petition is disposed of. All pending applications stand disposed of.
Record of the learned trial be sent back forthwith.
