Koushalya And Ors.
----Petitioners Versus State And Anr.
----Respondents
For Petitioner(s) : None present. For Respondent(s) : Mr. J. K. Mishra.
Ms. Shalini Audichya for Mr. Vinit Sanadhya.
HON'BLE MS. JUSTICE REKHA BORANA Order 17/05/2022
None appears for the petitioners.
It has been submitted by the learned counsel for the
respondents that the controversy in question has been decided by
the Jaipur Bench of this Court in the case of S.B. Civil Writ
Petition No.13009/2017; Ramavtar Choudhary v. State of
Rajasthan & Ors. (decided on 31.07.2018). The said judgment
has been affirmed by the Division bench in D.B. Special Appeal
Writ No.1177/2018 (decided on 23.07.2019).
Counsel for the respondents further submits that in view of
the fact that an interim order in the present matter had also been
passed relying upon the said judgment only, therefore, after the
decision in the case of Ramavtar Choudhary (supra), the
present writ petition also deserves to be dismissed.
As none has appeared on behalf of the petitioners today, list
the matter on 19.05.2022.
Application for preponement of date is disposed of.
