This writ petition has been filed by the petitioner-institution

being aggrieved with the action of the State Government of not

issuing NOC for conducting B.Sc.(N) course with enhanced intake

capacity of 80 seats for the academic session 2021-22.

Learned counsel for the petitioner-institution has submitted

that the committee constituted by the Rajasthan Nursing Council

(2 of 2)

(RNC) has recommended that the petitioner-institution be allowed

to conduct B.Sc.(N) Course with enhanced capacity of 80 seats in

the academic session 2021-22. It is further submitted that despite

receiving the said recommendation, the State Government is not

issuing NOC to the petitioner-institution.

Learned counsel appearing for the respondent-State is not in

a position to dispute the fact that the recommendations of the

committee constituted by the RNC are in favour of the petitioner-

institution and is also not in a position to inform this Court that as

to when the State Government is going to issue NOC in favour of

the petitioner-institution.

In such circumstances, I deem it appropriate to dispose of

this writ petition with a direction to the respondents to permit the

petitioner-institution to participate in the on-going counselling for

B.Sc.(N) course for the academic session 2021-22 with the intake

capacity of 80 students as recommended by the committee

constituted by the RNC.

The petitioner-institution shall deposit due fee/affiliation fee,

if any, within a period of one week.

Stay petition stands disposed of.
