Order

11/05/2022 Counsel for petitioners submits that prior to filing of present

civil suit, plaintiff has filed a revenue suit before the Court of Sub

Divisional Officer, seeking declaration of his Khatedari rights. The

previous revenue suit has been rejected vide order dated

05.10.2021 with finding that plaintiff does not have any vested

right in the lands in question. Counsel for petitioners submits that

subsequent civil suit seeking declaration of sale deed executed by

the grandfather and father of plaintiff in favour of petitioner-

purchaser is not liable to proceed on merits.

Counsel for petitioners has placed reliance on the judgment

passed by the Hon'ble Supreme Court in case of Pyarelal Vs.

Shubhendra Pilania [(2019) 3 SCC 692].

Heard.

Appeal is admitted.

Issue notice to respondents.

                                          In   the   meanwhile,       further       proceedings     of   civil   suit

No.32/2021 shall remain stayed.
