Learned counsel for the respondents would submit that the
State is adopting pick and choose method having filed appeal in
(2 of 2) [SAW-389/2022]
the case of State of Rajasthan Vs. Balaji BSTC College and
Another in D.B. Civil Special Appeal (Writ) No. 152/2022.
On the other hand, Learned Additional Advocate General
would submit that issue involved in all the cases is one and the
same and vide order dated 04.03.2022, the Division Bench of this
Court at Principal Seat, Jodhpur has stayed the impugned
judgment, meaning thereby that the judgment, which has been
passed in the case which was relied upon by the learned Single
Judge to pass an order in favour of the respondents, has been
stayed.
Having heard learned counsel for the parties and taking into
consideration the order dated 04.03.2022 passed in the case of
State of Rajasthan Vs. Balaji BSTC College and Another in D.B.
Civil Special Appeal (Writ) No. 152/2022, we are not inclined to
vacate the interim order passed by this Court.
Application (No. 2/2022) for deciding stay application filed by
the appellants is, therefore, rejected.
