1. This Habeas Corpus Petition under Article 226 of the
Constitution of India, 1950 has been filed by the petitioners for
production of the corpus who happens to be and is missing since
2019.
2. In pursuance of the order passed by this Court, Mr. Shanker
Lal Meena, CO, Lalsot, Dausa, has submitted a factual report
(2 of 2) [HC-357/2021]
indicating that the corpus is missing since 2019 for which a
missing person report (MPR) was lodged at Pune, Maharashtra and
the Police Officials at Pune, Maharashtra are trying to search the
corpus. In the F.I.R. lodged by the petitioners at Police Station,
Lalsot, District Dausa, after thorough investigation, the police has
submitted negative final report before the competent Court.
3. It is also submitted that after submission of final report, now
the matter has been reopened with the orders of Superintendent
of Police. In the F.I.R. petitioners have levelled allegations against
certain persons about the demand of ransom etc. but after
investigation and re-investigation the police found those
allegations to be incorrect.
4. The grievance of the petitioners is that they are not aware
about the progress of investigation. Since the corpus is missing
from Pune, Maharashtra and the Police Officials of Pune,
Maharashtra are making efforts to search the corpus, petitioners
are at liberty to avail remedies available to them at Maharashtra
and they are also at liberty to submit an application before the
concerned Court to get the status of the F.I.R. lodged by them.
5. With the above observations, this Habeas Corpus Petition
stands disposed of.
