Order

27/06/2022

This writ petition has been filed by the petitioner seeking

change in category from General (widow) to EWS (widow) for the

post of School Lecturer (Geography).

It is inter-alia claimed that pursuant to the advertisement

dated 13.04.2018 issued by the RPSC, petitioner applied and

indicated her status as General (widow) and now the petitioner,

after declaration of result, is seeking change of status as EWS

(widow).

Learned counsel for the respondents made submissions that

several opportunities were granted by the RPSC after the issuance

(2 of 2) [CW-7418/2021]

of the advertisement to the candidates to change their category, if

any, however, the said chance was not availed by the petitioner

and after issuance of the result by the respondents change in the

category is not permissible.

Reliance has been placed on order of this Court in Mamita

Choudhary Vs. State of Rajasthan & Anr.: S.B. Civil Writ Petition

No.9091/2020, decided on 09.10.2020.

In the case of Mamita Choudhary (supra), which pertains to

the same recruitment, a Coordinate Bench of this Court while

relying on the judgment of this Court in Piyush Kaviya & Ors. Vs.

The RPSC & Ors.: S.B. Spl. Appeal Writ No.198/2018 and other

connected matters, decided on 10.04.2018 came to the conclusion

that as the candidate had not approached the RPSC pursuant to

the corrigendum and press note issued on 19.09.2019 and

16.01.2020, the petitioner therein was not entitled to any relief.

In view of the view taken by the Coordinate Bench of this

Court in Mamita Choudhary (supra) pertaining to the same

recruitment, no case for interference is made out in the present

petition.

The same is, therefore, dismissed.
