Learned counsel for petitioner submits that the complainant
had already lodged a complaint under Section 138 of NI Act
against the petitioner, wherein after due trial, the petitioner has
been acquitted vide judgment dated 06.08.2018 and thereafter,
the complainant lodged the FIR on 10.05.2022 for offences
punishable under Sections 420, 406, 323, 384 of IPC in relation to
the non-payment of the amount of same cheques.
Issue notice to respondents.
In the meanwhile, petitioner shall not be arrested. However,
investigation will continue.
