Appellant has challenged the judgment dated 26.04.2022

passed by Special Court, Protection of Children from Sexual

Offences Act, 2012 and Child Right Protection Commission Act,

2005 No. 1 Bundi whereby he has been convicted and sentenced

for offence under Section 376 (2) (N) of IPC and Section 5 (L)/6 pf

POCSO Act, 2012. Alongwith appeal, appellant has filed this

application for suspension of sentence.

Learned counsel for the appellant submits that accused was

on bail during trial and at present he is in judicial custody since

26.04.2022.

Heard learned counsel for the accused-appellant as well as

learned Public Prosecutor and perused the material available on

record.

Considering the facts and circumstances of the case but

without commenting on merits of the case; I deem it just and

proper to suspend the sentence awarded to the accused-petitioner.

Accordingly, the application for suspension of sentence is

allowed and it is ordered that the sentence passed by court/s

below against the accused-appellant Sonu S/o Radhakishan shall

remain suspended, provided he execute a personal bond in the

sum of Rs.50,000/- along with two sureties in the like amount

each to the satisfaction of the trial court for his appearance in this

court on 13.07.2022 and as and when called upon to do so.
