Instant contempt petition has been filed alleging

disobedience/non-compliance of interim order dated 29.06.2009

passed in S.B. Civil Writ Petition No.7154/2009 whereunder and

whereby, the candidature of petitioner was to be considered for

promotion in DPC, without taking into account his punishment of

censure.

It is not in dispute that thereafter the writ petition has

finally been dismissed vide judgment dated 04.10.2016.

In that view of matter, compliance of interim order becomes

redundant and the contempt petition does not survive any further.

Accordingly, the contempt petition is dismissed. However, in

(2 of 2) [CCP-134/2014]

case after passing final judgment dated 04.10.2016, any

subsequent development took place in order to secure

compliance of interim order dated 29.06.2009, the petitioner may

avail appropriate remedy and the dismissal of this contempt

petition will not come his way.
