This criminal misc. petition under Section 482 Cr.P.C. has

been filed by the petitioner with a prayer for quashing the FIR

No.371/2021 of Police Station Kankroli, District Rajsamand.

Learned Public Prosecutor has submitted the factual report,

wherein it is mentioned that in the impugned FIR the police have

already arrested the petitioner on 23.01.2022 and at present he is

in judicial custody. At this stage, learned counsel for the petitioner

has submitted that he may be allowed to withdraw this criminal

misc. petition, however, seeks liberty for the petitioner to raise all

his defence before the appropriate form.

Accordingly, the criminal misc. petition is dismissed as

withdrawn with the liberty sought for.
