Learned counsel for the appellant stated that though
necessary party applicant was not joined as a respondent in the
writ petition he has therefore prayed for leave to appeal against
the judgment of the learned Single Judge.
Considering the submissions made the application is allowed.
Leave to appeal is granted.
D.B. Special Appeal Writ No. 356/2022:-
Learned counsel for the appellant submitted that the
objections raised by the appellant before the executing court are
pending. According to the appellant he is in possession of the suit
property by virtue of an agreement to sell dated 11.06.2007.
Without joining the appellant as respondent the petitioner had
filed the said writ petition. The petition involves disputed question
(2 of 2) [SAW-356/2022]
of facts. The learned Single Judge disposed of the writ petition
directing the authority to ensure that no disturbance is caused in
entering the property or involvement of any third party rights.
Issue notice, returnable on 22.03.2022.
