Heard learned counsel for the parties.
Having regard to the submissions made by the learned
counsel for the parties, in my view, matter requires consideration.
Hence, the appeal is admitted on the following substantial
questions of law:-
"(I) When there is neither any application of the plaintiff for getting the agricultural electricity connection nor any demand note was issued to him nor he deposited any amount for that purpose, the plaintiff can claim status of a Consumer?"
(II) Whether the judgment and decree passed by the First Appellate Court is based on misreading and non reading of the material evidence on record i.e. Ex. D/1 to D/4?
Since, respondent is duly represented by his counsel,
fresh notice need not be issued to him.
Record has already been received.
