Shri Ankit, learned counsel puts in appearance on behalf of
the respondent No.1.
Heard on application under Section 5 of the Limitation Act.
For the reasons and grounds mentioned therein, the
application under Section 5 of the Limitation Act is allowed. The
delay in filing the leave to appeal is condoned.
Having heard learned counsel for the parties and perusing
the judgment impugned, this Court is of the opinion that there are
valid and substantial grounds for grant of leave to appeal to the
appellant for filing an appeal against the judgment of acquittal of
the respondent.

Accordingly, the application for grant of leave to appeal is
allowed. The memo of leave to appeal be treated as appeal. Office
to proceed.
