Learned counsel for petitioners submits that respondents-

plaintiffs have instituted a civil suit for declaration of khatedari

rights which is pending before the revenue court and thereafter

has instituted the civil suit before the civil court challenging the

gift deed.

Learned counsel for petitioners has placed reliance on

judgment passed by Hon'ble Supreme Court in case of Pyarelal

Vs. Shubhendra Pilania (minor) & Ors. reported in [(2019)

3 SCC 692].

Heard.

Admit.

Issue notice to respondents.

Record of court below be summoned.

In the meanwhile, further proceedings of case

No.34/05/2021 pending before the court of Additional District

Judge No.4, Alwar shall remain stayed.
