Order 04/08/2022 Learned counsel for the petitioner submits that the findings
of the Board of Revenue Rajasthan, Ajmer (for brevity, "BoR") are
perverse inasmuch as no 'Rajinama' was signed either by them or
by any other co-sharers. He submitted that the petitioners were
not given any opportunity to raise objection against the report
dated 22.06.2018 prepared by the Tehsildar behind their back and
they were not even present at the time of passing the final decree.
Issue notice of the writ petition as well as of stay application.
Notices be given "dasti".
Additionally, the petitioners are permitted to serve the
respondents through their counsel(s) appearing before the learned
trial Court.
Heard learned counsel on interim relief.
Taking into consideration the contentions advanced by the
learned counsel for the petitioners and the material on record, this
Court deems it just and proper to stay the operation and effect of
the judgment dated 03.03.2021 passed by the BoR in Appeal
(2 of 2) [CW-6954/2021]
Decree No.8650/2018/TA/Jaipur with a further direction to the
parties to maintain status quo qua the subject land, till further
orders.
