Heard on prayer for grant of leave to appeal as also on

admission and stay.

Taking into consideration that the effect of the impugned

judgment is that the appellants have been ousted though they

were selected, therefore, the proposed appellants are persons

aggrieved. In view of the judgment dated 31.03.2022 passed by

this Court in the case of Om Prakash (Since Deceased) & Others

Versus Girraj & Others (D.B. Special Appeal (Writ) No.1183/2018),

we are inclined to grant leave to the appellants to file the present

appeal.

Accordingly, leave to file appeal is granted to the appellants

and the application seeking leave to file appeal is allowed.

A copy of memo of appeal has been supplied to the learned

counsel for the caveator.

A copy of memo of appeal along with stay application be also

supplied to Ld. Additional Advocate General for the concerned

department, counsel for the Rajasthan Staff Selection Board and

counsel for the National Council Teachers Education within three

days.

Reply to the stay application may be filed by the counsel for

the caveator and if so advised, by other respondents.

The case be listed for consideration on stay application in the

week after next along with D.B. SAW No.521/2022.
