This appeal has been filed by owner and driver of vehicle
assailing judgment and award dated 13.12.2021 passed by M.A.C.T,
Bharatpur in MAC No.550/2016 (377/14).
The counsel for appellants submits that the Tribunal has wrongly
exonerated the Insurance Company from the liability on the ground of
breach of policy.
Heard.
Admit.
Issue notice to respondents.
In case, appellants deposit a lump-sum amount of Rs.10 lakh
within a period of four weeks, the execution of impugned judgment and
award against appellants shall remain stayed.
On deposition of said amount, deposited amount of Rs.10 lakh
may be disbursed to respondent-claimants.

It is made clear that if appellants will not deposit the aforesaid
amount, respondent-claimants would be free to pursue the execution of
the impugned judgment and award.
The Tribunal may first complete the exercise of deposition and
disbursement of compensation, as mentioned above, thereafter shall
send the record to this Court.
