Judgment / Order

27/10/2021

1. Petitioner has filed this fifth (interim) bail application under

Section 439 of Cr.P.C.

2. F.I.R. No. 110/2019 was registered at Police Station Khetri

Nagar, District Jhunjhunu for offences under Sections 147, 148,

149, 450, 302, 458 & 459 and Sections 3/25 of Arms Act.

3. It is contended by counsel for the petitioner that petitioner's

father has been murdered. Copy of the FIR has been annexed with

the petition. It is also contended that petitioner was earlier also

given benefit of bail and after expiry the period of interim bail he

surrendered before the jail authorities.

4. Learned Public Prosecutor has opposed the fifth (interim) bail

application.

5. I have considered the contentions.

6. Taking note of the fact father of petitioner has expired.

Petitioner was earlier also given benefit of interim bail and he

surrendered after the expiry the period of interim bail and

considering the averments made by counsel for the petitioner to

be true, I deem it proper to allowed the prayer for fifth (interim)

bail application for 15 days.

7. The 5th interim bail is accordingly allowed and petitioner is

granted fifth (interim) bail for a period of 15 days and it is directed

that accused-petitioner shall be released on interim bail for 15

dyas provided he furnishes a personal bond in the sum of Rs.

1,00,000/- (Rupees One Lac only) together with two sureties in

the sum of Rs. 50,000/- (Rupees Fifty Thousand only) each to the

satisfaction of the learned trial Court with the stipulation that he

shall surrender before the Jail Authorities on 12.11.2021.

8. A copy of this order be sent by fax to the concerned Jail

Authority as well as to the concerned Sessions Judge.

9. Petitioner is directed to surrender before the concerned Jail

Authorities on 12.11.2021.
