1. It is contended by counsel for the petitioner that the
petitioner was the Assistant Vice President (Legal) in the company.
He was not responsible for the conduct of the business of the
company and as such, no offence could have been made out
against him. It is also contended that in the complaint, there is no
whisper that petitioner is in charge of, and was responsible to, the
company for the conduct of the business of the company.
2. Learned Public Prosecutor has opposed the misc. petition.
3. I have considered the contentions and have perused the
complaint.
4. There is no whisper in the complaint that petitioner is in
charge of, or was responsible to, for the conduct of the business of
the company.
5. Issue notice to the Respondent No.2
6. In the meantime, proceedings qua the petitioner shall remain
stayed.
