Judgment / Order

1. Complainant-Petitioner has preferred this criminal misc.

petition under Section 482 Cr.P.C. seeking quashing of the

proceedings pending before the trial Court.

2. It is contended by complainant-petitioner that a compromise

application was filed before the trial Court but the trial Court

rejected the application on the grounds that the offence under

Section 354 IPC is non-compoundable.

3. I have considered the contentions.

4. Taking note of the fact that the complainant-petitioner has

approached this Court for quashing of the proceedings pending

before the trial Court and has submitted that parties has amicably

settled their dispute, I deem it proper to allow the misc. petition.

5. Accordingly, Criminal Misc. Petition is allowed. Offence under

Section 354 IPC is compounded and the proceedings pending

before the Court below are quashed. A copy of this order be sent

to the Court below. Stay application also stands disposed.
