     In wake of second surge in the COVID-19 cases, abundant

caution is being maintained, while hearing the matters in Court,

for the safety of all concerned.

     Learned      counsel       for   the    petitioner          submits   that   the

controversy in question is covered by the judgment passed by this

Court in the case of Kiran Kumari Vs. State of Rajasthan &

Ors. (SBCWP No.14964/2019), decided on 15.01.2020.

     Issue notice to the respondents.

                                        Learned AAG Mr.K.S. Rajpurohit is directed to accept notice

                                   on behalf of the respondents no.1 to 3. He accepts notice and

                                   seeks some time to complete the instructions. However, he prima-

                                   facie admits that the controversy is covered by the judgment

                                   passed by this Court in the case of Kiran Kumari (supra).

                                        Issue notice to the respondent no.4, returnable in four

                                   weeks.

                                        In the meanwhile, effect and operation of the order dated

                                   24.09.2021 shall remain stayed qua the petitioner.
