Learned counsel for the petitioners submits that during the
pendency of the present writ petition, in the execution
proceedings filed before the learned trial Court, the possession of
the suit property has already been taken by the respondent,
therefore, the present writ petition has become infructuous.
Learned counsel for the petitioners submits that certain
articles which belonged to the petitioners have also been taken
away by the respondents and, therefore, he seeks liberty to

agitate the issue of recovery of their articles before the learned
trial Court in the execution proceedings.
The present petition is, therefore, dismissed as having
become infructuous with the liberty as aforesaid.
